01.Liability & Property
Customer agrees to hold and keep harmless Photographika LLC, its agents and employees for any and all property damages and/or bodily injury damage caused by the customer's guests or other persons attending the party.
Customer agrees not to hold Photographika LLC responsible for inclement weather or other Acts of God that may cause the cancellation of the party. Should something of this nature cause the cancellation of the party, Photographika LLC shall apply any remaining monies due to another party date and location that is mutually agreeable to both parties.
02.Allergic & Medical Reactions
The client assumes all liability and responsibility for allergic reactions or any other medical reaction stemming from the menu, wearing of costumes, make-up, or any activity taking place before, during, or after the party.
03.General Provisions
Invalidity or unenforceability of one or more provisions of this agreement shall not affect any other provision of this agreement. Photographika LLC may elect not to exercise rights specified in this agreement. By doing so, Photographika LLC does not waive their right to exercise those rights at a future date.
This Agreement may be executed in multiple counterparts, and each such executed counterpart shall be deemed an original, but all of which together shall constitute a single agreement.
Electronic or digital signatures to this Agreement are acceptable and carry with it the same full force and effect as a handwritten signature. In the event of litigation relating to the subject matter of this Party Agreement, the client will be responsible for all reasonable attorney fees and costs resulting therefrom on behalf of Photographika LLC. This agreement is subject to the laws and regulations of the Commonwealth of Puerto Rico.
04.Photo & Video Usage
We reserve the right to post your party/event photos as an example of our services for promotional purposes on our Facebook, Instagram, website, and other digital or print resources. We never use any full names (first names only) as subtitles or captions of our photos. If you prefer to not have your child's photo shared, please let us know in advance.
05.Inclement Weather / Illness
In the case of severe weather or unforeseen circumstances/illness, Photographika LLC reserves the right to reschedule your party. If you choose to cancel the party due to severe weather or illness, please remember that your retainer is non-refundable. We will gladly work with you to reschedule your party for an alternate date. Please be advised, if food or beverages are needed there may be an additional charge.
06.Cancellations & Rescheduling
Once your party is booked and the deposit is paid, the party can only be postponed one time. Based on availability, we will gladly work with you to reserve an alternate date for your party within 60 days of the original date. If you decide to cancel your party for any reason, the retainer is non-refundable.
07.Retainer & Final Payment
A non-refundable retainer of $200 and completed contract are required in order to reserve a date/time. The remaining balance will be due 7 days prior to your party/event date. We will send a courtesy reminder with a breakdown of your balance owed. You may pay the balance via ATH Móvil Business, credit card, or cash.
You may also request a PayPal invoice to pay the balance by credit or debit card (5% service fee applies). We accept payment via PayPal, Credit/Debit Card & Cash.
08.Late Arrivals
Please advise all guests that the party will begin promptly at the scheduled time. All activities are carefully planned out, and any child arriving late may join the activities at the point that they have progressed. This is necessary to ensure the least amount of disruption to the party. We cannot work backwards or pull out supplies that have already been cleaned up for a child who arrives late.
09.Discipline & Non-Participation
Our staff will be responsible for the flow of the party and the party activities. We kindly ask that you, the party hostess, monitor disruptive behavior and attend to any child who does not want to participate. This will help us to provide the best possible party experience for you and your child.
10.Food & Skin Allergies
It is the responsibility of the client to check with party guests for specific food allergies. Should any of your guests have severe food allergies, we suggest that either you or the child's parent provide an alternate menu for that child. It is also the responsibility of the client to check with the guests for skin allergies or sensitivities. This is in regard to the make-up/glitter.
11.Adults at the Party
We ask that the parent(s) of the birthday child please stay for the duration of the party to attend to possible needs of the children. The parents of guests are welcome to stay and enjoy the fun, but we ask that onlookers keep the noise level to a minimum so the children do not get distracted and can adequately hear instructions from the hostess.
12.Liability Release
Photographika LLC, its owners and employees assume no responsibility or liability for accidents, allergies relating to food items, clothing, or make-up, injuries to party guests, or property damage. As professional event planners, we can assure you we will do all in our power to provide a safe and entertaining environment for your guests.
13.Damages
We understand that accidents can happen, however, the client may be held responsible for the excessive damage sustained to costumes and property of Photographika LLC.
